Where to keep and Where to find?

Whenever I approach someone to keep their will in our company, people always ask:
??? Why can't I just keep it at my house?
??? I can always keep it at my lawyer's firm
??? Can I bury it somewhere my family doesn't know?
??? Why must a will kept? Can't it just keep it as a usual document?
??? Why do I need to pay so much for your company only to keep my will?
... ... ...

Well, you can always keep your will at any place you prefer. 

Just the matter, is it safe enough? 

Will there be someone who would like to amend the content? 

Will your family know where you keep to get it when you pass away?

I don't think you're going to hang your will in your living hall to let every guest view it. 

And I don't think is a good idea to keep it without being able to reach by anyone.

Under the law, a person who is qualified to certify shall not certify a true copy of a photocopy document without sighting the original document as it is a serious offence if the original surfaced later and was found to be different from that certified.

Some testators wouldn't like to have family members to know where their Will is kept. When the testator passed away, his family will not able to locate the original Will. Although some of them will have a photocopy of Will for the family, but if the photocopy is not accepted as evidence, then the estate has to be handled through the application of a letter of administration which delays the process considerably.

Some clause are compulsory in a valid Will. You might think any extra clause in your Will cost you more money. However, if there's lack of those compulsory clauses, it will cost your beneficiary more time and money at the end of the day.

Have A Residual Clause
If you do not include a residuary clause, any assets not listed in your Will must be distributed in accordance with the laws of intestacy in Malaysia. This clause also ensures that any asset that you acquire after you have written your Will is distributed and saves the hassle of rewriting your Will all the time.

Some people will think, anyone can be executor. Some just appoint whoever close to them as Guardian of their children.

Questions is, is the person really suitable to be your executor? Is he / she has the time to execute the Will? Is the Guardian being appoint able to take care of your children if nothing much you can pay them?

7. Appointing Unsuitable Executors
The role of an executor may be challenging for someone. They will need to manage the estate (assets of the deceased), appoint a lawyer to apply for probate, deal with the court, collect assets, pay outstanding debts etc. Sometimes the executor may have to use their own money first to pay for legal fees to obtain your probate.

Ya, I admit, I would like buy something cheap and useful.
I don't like to pursue my client to spend too much unnecessary expense on will writing if the clause is not a necessary issue or better not to be listed in will (funeral arrangement, etc)

However, some client would like to reduce this and that clause, which is very dangerous -- it can lead to invalid will.
I will say, I can only suggest, advice and remind. If you insist the cheaper but dangerous will, I can't help much.

5. Not Identifying Assets Adequately
Assets with legal titles are easily identified. However with assets like jewelry, paintings and collectibles, you must identify them clearly to ensure there is no ambiguity.

3. Selecting The Wrong Person To Be Witness
If your witness is also a beneficiary or the spouse to a beneficiary in your Will, then that person forgoes his or her gift. A gift made to someone who witnesses your Will is deemed to be null and void.

Without a Will, all of these decisions are left to a court to determine in accordance with distribution laws in Malaysia.

1. Unknown Location Of Your Will
If a Will cannot be found, it is assumed that you have not written one.
HOW TO PREVENT THIS - tell others where your Will is kept. If you change its location, remember to inform them. Alternative, keep all the important documents like titles, insurance policy
documents and your Will together in one location.
BEST SOLUTION - keep under trustee company's custody

The Need For Document Custody (3)

          Every individual will have one custody number and will get the same custodial service. Therefore, it is not possible for two persons’ Wills to be kept as one just as the husband and wife cannot share the same pair of shoes. Besides, this is our control so that only the appointed executor, upon the testator’s death, has access to the particular Will. Unless duly appointed as the executor, even the spouse has no access to the Will.

          Considering that you will probably live longer than 10 years, the cost for lifetime custody spread on a daily basis is really low. The Will is an important document and it is well worth the money spent. Furthermore, you will get 20% discount on your future rewriting fee.

The Need For Document Custody (2)

          Once your Will is deposited into the Rockwills custody centre, it will be closely monitored, coded with a special vault storage reference number and custody card for controlled access.

          I strongly not recommend anyone to keep Will in a safe deposit box! The problem is that when a person passes away, all the assets including the safe deposit box will be frozen even if it is in joint names. As such, the beneficiaries will need to get a court order in order to open the safe deposit box which incur additional costs and inconvenience. Moreover, there is the problem of loss of privacy and confidentiality. When it is kept in the safe deposit box, the joint account holder will also have access to the Will.

          The risk of keeping your Will at home is the possibility that it gets misplaced. A Will that cannot be found is as good as no Will. Then there is the risk of damage by water, fire or pests. And the risk of prying eyes and tampering. Many a case has happened where relationships have been damaged because the contents of the Will were read or where the original Will is not found and therefore probate application cannot be made because a close family member has destroyed the Will of the deceased upon discovering that the distribution was not to his/her satisfaction.
