Mr. Tan was a successful businessman and held stakes in various businesses and properties. For various reasons, he used several nominees to hold his assets. He was receiving a good monthly income, in excess of RM30,000 through these nominees. It was estimated that the value of his investments amounted to RM10 million.

Some clause are compulsory in a valid Will. You might think any extra clause in your Will cost you more money. However, if there's lack of those compulsory clauses, it will cost your beneficiary more time and money at the end of the day.

Have A Residual Clause
If you do not include a residuary clause, any assets not listed in your Will must be distributed in accordance with the laws of intestacy in Malaysia. This clause also ensures that any asset that you acquire after you have written your Will is distributed and saves the hassle of rewriting your Will all the time.

Some people will think, anyone can be executor. Some just appoint whoever close to them as Guardian of their children.

Questions is, is the person really suitable to be your executor? Is he / she has the time to execute the Will? Is the Guardian being appoint able to take care of your children if nothing much you can pay them?

7. Appointing Unsuitable Executors
The role of an executor may be challenging for someone. They will need to manage the estate (assets of the deceased), appoint a lawyer to apply for probate, deal with the court, collect assets, pay outstanding debts etc. Sometimes the executor may have to use their own money first to pay for legal fees to obtain your probate.

Ya, I admit, I would like buy something cheap and useful.
I don't like to pursue my client to spend too much unnecessary expense on will writing if the clause is not a necessary issue or better not to be listed in will (funeral arrangement, etc)

However, some client would like to reduce this and that clause, which is very dangerous -- it can lead to invalid will.
I will say, I can only suggest, advice and remind. If you insist the cheaper but dangerous will, I can't help much.

5. Not Identifying Assets Adequately
Assets with legal titles are easily identified. However with assets like jewelry, paintings and collectibles, you must identify them clearly to ensure there is no ambiguity.

With an invalid will, is just like without a Will.

3. Selecting The Wrong Person To Be Witness
If your witness is also a beneficiary or the spouse to a beneficiary in your Will, then that person forgoes his or her gift. A gift made to someone who witnesses your Will is deemed to be null and void.
HOW TO PREVENT THIS - It is better asking close friends to be witnesses rather than family members who may be a potential beneficiary.

If a Will cannot be found, it is assumed that you have not written one.
HOW TO PREVENT THIS - tell others where your Will is kept. If you change its location, remember to inform them. Alternative, keep all the important documents like titles, insurance policy
documents and your Will together in one location.
